Joe Arpaio's Failed Probes Continue To Plague Him

PHOENIX -- Failed corruption investigations launched by America's self-proclaimed toughest sheriff have succeeded in getting one of the lawman's top allies disbarred.

And despite Maricopa County Sheriff Joe Arpaio's efforts to distance himself from cases at the center of a legal ethics panel inquiry that cost a pair of former county prosecutors their careers ? the fallout has moved closer.

"Sheriff Arpaio is the next big step," said Mary Rose Wilcox, a Maricopa County official who has been at odds with the sheriff and his allies. "He will fall."

Arpaio has denied wrongdoing, but the three-member disciplinary panel of the Arizona courts said Tuesday that evidence suggests the sheriff conspired with Maricopa County's former top prosecutor to intimidate a judge with unfounded criminal charges.

The ethics board's sweeping ruling against former Maricopa County Attorney Andrew Thomas and one of his assistant prosecutors says they wrongfully brought criminal charges against a pair of county officials, including Wilcox, in December 2009.

The panel said the charges were brought to embarrass the county officials and the judge who had been at odds with Arpaio and Thomas.

Arpaio and Thomas have defended their actions, saying they were working to root out corruption in county government.

Arpaio does not face punishment, but investigations by his anti-public corruption squad were discussed heavily during the ethics investigation into Thomas and one of his deputy prosecutors, Lisa Aubuchon.

Arpaio testified during the hearings, saying in September that he didn't follow the investigations closely and delegated the cases to his then-top assistant David Hendershott.

The ruling disbarring Thomas and Aubuchon marked the first official comment by the state's legal establishment on the validity of the investigations.

It also supported lawyers who said Arpaio and Thomas wrongly went after judges, attorneys and government officials who crossed them, using criminal investigations as a weapon.

Longtime critics are predicting the damage from the failed cases will do what Justice Department lawsuits, claims of civil rights violations and protests over his hardline stance on immigration could not ? hurt him with voters.

But predictions of Arpaio's political demise have cropped up many times over his five terms in office, often centering on the deaths of inmates in his jails or his immigration patrols that critics say are infected by racial profiling.

And Arpaio is fond of pointing out that he has survived many storms in the past.

Arpaio, who rarely declines an interview request, commented on the ethics panel rulings Tuesday only through a written statement that described Thomas as a "hard-working professional who served the people of this county for many years."

Arpaio also said in the statement, "Today's decision no doubt is a disappointment to Andrew Thomas, his family and his colleagues."

The sheriff it would be inappropriate to comment further.

County officials who were targeted in the investigations say the sheriff has run baseless investigations and tried to intimidate county workers for years.

Arpaio and Thomas became embroiled in a yearlong political blood feud with county officials, including County Supervisors Wilcox and Don Stapley.

They brought criminal charges against the officials and a then-Superior Court Judge Gary Donahoe in December 2009.

All three cases were dismissed after a judge ruled that Thomas prosecuted one of the officials for political gain and had a conflict of interest in pressing the case.

The ethics panel ruled that Thomas and Aubuchon broke criminal intimidation and perjury laws in knowingly bringing false bribery charges against Donahoe.

"It was clear to us that Mr. Thomas and Ms. Aubuchon were not working independent of the sheriff and vice versa," said John Gleason, an attorney who led the case on behalf of the State Bar of Arizona.

Other county officials and judges who were at odds with Arpaio and Thomas also were investigated but weren't charged with crimes.

Thomas, who called the ethics case against a "political witch hunt," said the decision to charge the judge had nothing to do with the decisions the judge issued against his office.

The panel pointed out the testimony of a sheriff's investigator who recounted the reactions of Aubuchon and Hendershott when they learned the court hearing had been called off. The investigator said Aubuchon looked pleased and Hendershott said, "checkmate."

The ruling said Hendershott credited Arpaio with coming up with the idea of charging the judge, and the sheriff's investigator who signed the criminal complaint hadn't done any investigation of Donahoe.

Separate from the attorney disciplinary case, a federal grand jury also has been investigating Arpaio's office on criminal abuse-of-power allegations since at least December 2009 and is specifically examining the investigative work of the sheriff's anti-public corruption squad that produced the unsuccessful probes.

Antonio Bustamante, a Phoenix civil rights attorney and critic of the sheriff's forays into immigration enforcement, said the Thomas decision, to some degree, politically hurts Arpaio, but he added that many voters don't realize Arpaio's office carried out the investigations.

"Those who know that Joe Arpaio was the investigative muscle behind much of what Thomas did will take note that Arpaio is tinged," Bustamante said.

Is corn syrup killing the honeybees? (+video)

A trio of recent studies faults a common family of corn pesticides for disorienting honeybees, potentially leading to colony collapse disorder. The German chemical company Bayer, which manufactures the pesticides, disagrees. ?

Since 2006, something awfully strange has been happening to North America's commercial beehives. Beekeepers are finding that many of the boxed hives ranged throughout their apiaries have been inexplicably abandoned by worker bees. These ghost-hives typically have ample stores of honey and pollen, and hold gestating colony broods, sometimes even a lone queen.

This phenomenon is called Colony Collapse Disorder (CCD), and two papers published recently in the journal Science say that it is correlated with the presence of a ubiquitous class of insecticide called neonicotinoids. A newer study published in the Bulletin of Insectology suggests that this insecticide is introduced into bee colonies through, strangely enough, high-fructose corn syrup.

The insecticide was developed by Bayer AG, the German chemical and pharmaceutical giant most recognized for its original brand of aspirin. Today, the $53 billion company has released a rebuttal to the suggested link between neonicotinoids and Colony Collapse Disorder.

The population of feral honeybees in the US has been steadily decreasing for the past half-century, and is now almost nonexistent. In the same timescale, commercial honeybees experienced a shallower decline in population. However, since 2006, they have started rapidly disappearing in North America and Europe. Many scientists agree that the confluence of factors that drove population decline before 2006 is still in effect, but that something probably changed in light of the new rash of colony collapses.

Identifying the causes of CCD is a complex proposition, but the disorder's symptoms and effects are quite simple. It usually occurs when worker bees first depart their hives to forage, in winter or early spring. Then they don't return. Their hives typically have an active queen, ample food, and a developing brood ? not exactly the home a bee would abandon under normal circumstances. Many scientists have since suggested that pesticides may disorient bees or affect their memory, making them unable to navigate home.

Chensheng Lu, an environmental scientist at Harvard and the lead author on the Bulletin of Insectology paper, was curious as to how the insecticide may be introduced into the colony, and decided to investigate high-fructose corn syrup, which for the past decade has been used by beekeepers to supplement hives that have been decanted of honey. Much of the US corn crop is treated with neonicotinoids, and so trace amounts of the insecticides can often be found in the sugary syrup.

Lu and colleagues designed an experiment that would expose hives to concentrations ranging from 20 to 400 parts per billion. Within 4 months, 15 of the 16 experimental hives had been emptied by what appeared to be CCD, according to the researchers.

As more studies are published on this subject, the link between neonicontinoids and CCD may become more apparent. In this case, Bayer AG could only be held indirectly accountable, as it is the beekeepers who are substituting the inexpensive syrup for bee honey, thereby introducing the pesticide.

Earlier today Bayer released a statement that criticized the Harvard study, asserting that the sample size was too small to be statistically significant and that the "authors ignored the scientific consensus that bee health is impaired by multiple factors, including inadequate diet, pests and parasites such as the varroa mite, microbial diseases, mismanaged colonies, and loss of genetic diversity."

These are not unreasonable criticisms. Though the study authors certainly didn't "ignore" a "scientific consensus" on the multiple factors that could cause CCD. They simply investigated one of them. Nonetheless, scientists are still puzzled by the many possible causes of the disorder. They're also concerned, and for good reason.

The common honeybee is widely recognized as the most important insect pollinator. They're extremely versatile, able to collect both nectar and pollen and to transport it. They are easily managed by beekeepers, and live year-round, which means they will service a wide variety of plants. They're also fecund; one simple colony can consist of one queen, a few hundred drones and roughly 80,000 workers. There is no realistic scenario in which we could operate our mass-scale farms without them.

Bayer's concerns about the studies are not all that surprising considering the company's financial interests. But if more research confirms that its neonicotinoids are afflicting the commercial honeybee population, then they are threatening an enterprise on which Bayer crucially depends: agriculture itself.

BEIRUT (AP) ? A U.N.-brokered peace deal for Syria appeared to collapse Sunday as the government made a new demand that its opponents provide "written guarantees" to lay down their weapons before regime forces withdraw from cities, a call swiftly rejected by the country's main rebel group.

The deal, brokered by U.N. and Arab League envoy Kofi Annan, was due to take effect on Tuesday, paving the way for negotiations to end the country's year-old crisis, which the U.N. estimates has killed 9,000 people.

Annan said last week that Syrian President Bashar Assad had accepted the plan and its call for government forces to pull back from urban centers. But on Sunday Syria's Foreign Ministry spokesman, Jihad Makdessi, placed a new condition ? that the opposition agree in writing "to halt violence with all its forms and their readiness to lay down weapons."

The commander of the rebel Free Syrian Army, Riad al-Asaad, said his group was prepared to abide by the Annan agreement, but rejected the government's new unilateral demand.

The FSA does not recognize the regime "and for that reason we will not give guarantees," he told The Associated Press by telephone from his base in neighboring Turkey. He said government forces should return to their bases and remove checkpoints from the streets.

Annan's six-point peace plan calls for government forces to withdraw from population centers by Tuesday, to be followed by a full cease-fire by both sides by 6 a.m. Thursday.

However, with the deadline looming, Syrian forces have stepped up attacks on restive towns in recent days, and activists say scores of civilians have been killed daily.

Annan condemned the government offensive, saying in a statement Sunday that "the present escalation of violence is unacceptable."

He also reminded the government "of the need for full implementation of its commitments," though it was unclear whether his statement was issued before or after Damascus imposed new conditions for complying with the truce.

The cease-fire was meant to pave the way for negotiations between the government and the opposition to end the country's year-old crisis. Street protests against Assad erupted 13 months ago, inspired by the Arab Spring's pro-democracy uprisings in the region, but the revolt has turned violent in the face of a brutal regime crackdown.

Since Assad first agreed to the peace plan, the Syrian opposition and Western leaders have expressed skepticism about his regime's intentions because of broken promises in the past and the recent escalation in attacks on opposition strongholds.

Last year, Assad agreed to an Arab-brokered peace plan similar to Annan's, pledging to work with observers who traveled to Syria on a mission to end the crackdown. But the regime failed to pull out its tanks from towns and cities, saying the country was under attack from the armed groups, and the bloodshed has escalated sharply since the League halted its observer mission on Jan. 28.

Makdessi, the Foreign Ministry spokesman, said Syria will not allow a repeat of what had happened in January, when Assad pulled back his armed forces from cities and their surroundings, only to see rebels flood the areas vacated by government troops.

"Armed terrorist groups used this to rearm its elements and spread its authority on entire districts," Makdessi said. He also alleged that Qatar, Saudi Arabia and Turkey are arming and funding the opposition and demanded guarantees that this will be halted.

Damascus-based activist Maath al-Shami said he is not surprised by the latest government tactic because "whenever the regime pulls out its troops and tanks, people will march to Damascus and topple the regime."

"Frankly speaking, the regime will collapse if checkpoints are removed," he said.

Annan's spokesman, Ahmad Fawzi, refused to comment on the Syrian regime's new conditions.

On Thursday, a U.N. statement raised the possibility of "further steps" if Damascus doesn't implement Annan's six-point peace plan, which Assad agreed to on March 25.

At the Vatican, Pope Benedict XVI implored Damascus to heed international demands to end the bloodshed.

"Particularly in Syria, may there be an end to bloodshed and an immediate commitment to the path of respect, dialogue and reconciliation, as called for by the international community," Benedict said in his traditional Easter speech.

With the deadline looming, Syrian troops pounded restive regions in the north and center of the country Sunday, a day after activists said more than 100 people were killed across Syria.

Some of the heaviest fighting Sunday was taking place in the central city of Homs, where government troops fired mortar rounds at the rebel-held neighborhood of Khaldiyeh, said activist Tarek Badrakhan from Homs.

"Mortar rounds are falling like rain," Badrakhan told The Associated Press via Skype as explosions could be heard in the background. He said troops were attacking on three fronts the rebel-held areas Deir Baalbeh, Khaldiyeh and Old Homs.

"They are giving the regime permission to kill and commit massacres," said Badrakhan referring to the cease-fire. He added that people have not been able to bury the dead in Khaldiyeh because of the shelling. He said that 40 bodies are piled in a room in a makeshift hospital, and that activists are trying to keep the bodies cold by directing a fan toward them.

"We might have to bury them in public gardens," he said.

The Britain-based Syrian Observatory for Human Rights said intense clashes occurred in Homs' Qusour, where defectors were able to kill four government soldiers and damage an armored vehicle.

In the northwest, the Observatory said regime troops were fighting near the town of Jisr al-Shughour. The group also reported clashes between troops and defectors in several towns in the northern province of Aleppo.

Activists also reported raids in the Damascus suburbs of Darya, Douma and Beit Jin.

The Local Coordination Committees said 23 people were killed Sunday, including five in Beit Jin. The Observatory said clashes and government troops shelling killed at least 14 civilians Sunday as well as seven defectors and 12 soldiers.

Musculoskeletal disorders (MSDs) are the main cause of occupational injury in Great Britain, affecting 1 million people every year and costing society ?5.7 billion. Rihanna Might Not Care What You Think About Her Contact with ...

You might have been pissed Rihanna reunited with Chris Brown professionally (I know I was) or that rumors about their romantic reunion continue to swirl. But Rihanna?s not apologizing for getting back in touch (and staying in touch) with her ex-boyfriend and domestic violence abuser. She?s going to do what she pleases.

In May?s issue of Elle, Rihanna talks about the ?backlash over their reconciliation:?

?The bottom line is that everyone thinks differently. It?s very hard for me to accept, but I get it. People end up wasting their time on the blogs or whatever, ranting away, and that?s all right. Because tomorrow I?m still going to be the same person. I?m still going to do what I want to do.?

As a domestic violence survivor, I?m worried about the message Rihanna?s decision to get back in touch with Brown sends.

Now, I rarely say celebs must be role models. Rihanna is her own person and of course can do as she wishes. But her reunion with Brown saddens me. Young people have grown up watching their abusive relationship unfold. We live in a rape culture normalizing and glorifying violence against women. Going a step further, Rihanna?s choice might reinforce the notion that domestic violence isn?t really a big deal, cementing the trivialization of partner abuse.

In the U.S., nearly 1 in 5 women has been sexually assaulted and 1 in 4 women will face domestic violence in her lifetime. Society often shames and blames victims of rape and domestic violence. But people don?t bring violence on themselves. Abusers are the ones to blame, not survivors. Domestic violence isn?t just something that occurs between two people in a relationship. It?s an insidious epidemic.

Rihanna fell in love Brown, her best friend and her ?first big love.? But their relationship began to deteriorate and turned toxic and dangerous. On her 2010 album Rated R which followed her abuse, Rihanna sang songs like ?Russian Roulette,? about how ?love is a terrifying game,? and ?Man Down,? accompanied by a revenge fantasy video. She ?channeled the pain of the assault and the breakup.?

In her 2012 song ?Birthday Cake? which Brown collaborated on, apparently Rihanna?s choice, the lyrics about ?blowing my candles out,? ?betcha wanna put your name on it,? ?I?mma make you my bitch,? and licking ?the icing off,? all paint imagery of food, sex, domination, ownership and consumption. These lyrics sicken me when I think about Rihanna singing a duet with her abuser.

In Ann Powers? astute analysis of Rihanna and ?Birthday Cake? at NPR, she asserts Rihanna doesn?t want to wear the mantle of a role model, or empowerment or freedom:

??What?s upsetting for those of us who admire Rihanna?s talent and boldness ? and for me as a feminist ? is that she has clearly not taken up the narrative of women?s enlightenment and self-liberation. Quite the opposite ? the story she wants to tell is the one in which the endangered woman doesn?t get out, or leaves for a while but comes back, or at best does leave, but can?t resolve the mixed feelings she has about her choice.?

J. Bryan Lowder at Double XX Mag speculates Rihanna?s motivated by wanting to shed her victim image but the public can?t ever forget that horrifying image, the notorious shocking photo of Rihanna?s bruised face:

?The original moment of upsetting intimacy should be canceled out by the new moment of empowerment?in our seeing that she chooses Brown. It?s just that, with that photo in the back of our minds, we can?t help but worry about her fitness to judge.?

Despite my disappointment over Rihanna?s decision to contact her abusive ex, I made the same mistake. I survived not one but two abusive relationships. After I broke up with one of the exes, I tried to remain friends with them. But I eventually had to ask myself, ?What the fuck are you doing??? I wouldn?t want one of my friends associating with their former abuser. So why was I? That?s when I cut off all contact.

It?s not easy to break the cycle of abuse. When someone abuses you (physically, emotionally, psychologically, fiscally), it doesn?t necessarily mean you stop loving them. Abusers often promise they?ll never do it again. And it?s so tempting to believe they?ll change. Survivors often blame themselves, thinking they could have done something different or that they somehow provoked the abuse. Some survivors desperately want to leave but can?t, worried they have nowhere to go and no way to support themselves. Or their partner threatens to take away their children or report them if they?re an undocumented immigrant. That?s why it?s so hard to leave and why so many return.

Some people say that because Rihanna forgave Brown, so it?s okay, we should all forgive him. Or because time has passed, it?s been 3 years, it?s okay. No, it?s not fucking okay. And others have voiced that they don?t believe Brown should be forgiven or that he should?ve performed at the Grammys. Brown is on probation till 2014 yet the Grammys still let him perform. And I?m sure commercialism and profit motivated their decision. But it also sends a clear signal: that abused women don?t matter.

Sasha Pasulka wrote a brilliant piece at Hello Giggles about how she?s not okay with Brown performing at the Grammys. She asserts that Rihanna is probably tired of ?being a poster child? for domestic violence survivors and is ?under no obligation to speak out about? her abuse. ?But someone has to? and she?s shocked more people aren?t speaking out:

?We ? the grown-up influencers in this country, the people with platforms and with educations and with power ? are allowing a clear message to be sent to women: We will easily forgive a person who victimizes you. We are able to look beyond the fact that you were treated as less than human, that a bigger, stronger person decided to resolve a conflict with you through violence. We know it happened, but it?s just not that big of a deal to us.?

But domestic violence is a big deal and should outrage us all. And that anger should motivate us to speak out and support survivors. ?Caperton at Feministe wrote:

?This is why we should still be upset. This is why we can?t just let it go. Because girls and women don?t just see his violent assault as a non-issue?they see it as a joke. Regardless of whether he ever beats a woman again or whether he feels really, really bad about what he did (of which we have yet to see evidence), if the response from anyone is ?It?s okay if he?s hot,? it means we as a society have a lot more work to do. If the response is, ?LOL domestic violence is so funny,? I have no idea where to even start.?

So why does it matter what Rihanna does? Because it influences young women and their opinions on relationships. Some teens believe Rihanna got what she deserved. This past February, those horrifying and disturbing tweets surfaced where women claimed they would let Chris Brown ?beat them any day.?

But this is symptomatic of a larger societal problem ? a culture that normalizes violence against women, dismisses survivors, tolerates abuse and trivializes domestic violence.

As Erin Gloria Ryan at Jezebel wrote:

?The women who offered themselves up for a Chris Brown face punching are not the problem; they?re the symptom of a culture that teaches people (and especially young women) that love is submitting to your partner?s ever whim and not holding them to any sort of behavioral standard.?

What are we teaching kids? Now 1 in 6 seventh graders are victims of dating violence, a horrifying statistic. We shrug off violent celebs abuse, respectable newspapers slut-shame victims, watch advertisements glorify street harassment and domestic violence in order to further profit or an agenda, and the media objectifies and commodifies women?s bodies. Domestic violence myths repeatedly circulate. People joke about rape and domestic violence. Society blames women?s actions, dress and behavior regarding abuse, rape or assault.

This is the world children grow up in. And it?s fucking frightening.

For me, I realized I deserved a healthy relationship, not one mired in abuse and shame. And that?s what made me eventually leave. We need to teach young women that they deserve better. We must teach children and teens that it?s never okay for someone to put their hands on their partner. Love should never hurt. Ever. These are the messages we need to send to young women and men.

Rihanna isn?t responsible for the fucked-up world we live in. She?s under no obligation to discuss her abuse and it?s certainly not her responsibility to fix social ills. She did absolutely nothing wrong; Chris Brown did. But I wish Rihanna would pause a moment and think about how people, especially young people, will view her actions and internalize her choices. Young women and men need to know that domestic violence isn?t something to be taken lightly.
