Samsung may have lost a billion dollar round here in the US, but it appears to have scored a victory in its patent battle against Apple in Japan today. Reuters and Bloomberg report a judge there decided its Galaxy smartphones and tablets did not infringe on an Apple patent. Apple sued Samsung there in September of last year, however the Tokyo District Court has ruled Samsung did not violate a patent that covered syncing music and video data with a PC. According to The Yomiuri Shinbun, presiding judge Tamotsu Shoji dismissed the claim, saying Samsung's implementation of this specific technology was not covered by the scope of Apple's patent and, Bloomberg reports, ordered Apple to pay the costs of the lawsuit. Just as we're seeing in US District Court in California however, one judgement doesn't mean the seemingly never-ending battle is over however because Apple may be able to appeal this decision to a higher court. WEST LAFAYETTE, Ind. (AP) ? Purdue linebacker Dwayne Beckford has been kicked off the team following his latest scrape with the law.
On Monday, coach Danny Hope said Beckford would be suspended indefinitely. The Lafayette Journal and Courier reported that after Wednesday's practice, Hope announced he had been dismissed from the program. A team spokesman confirmed the move Thursday.
Beckford had 91 tackles last season and was Purdue's second-leading tackler.
He has been arrested four times in 14 months, the latest coming about one month after Beckford pleaded guilty to charges of operating a vehicle while intoxicated and illegal consumption of alcoholic beverages.

Proteins adorning the surfaces of human cells perform an array of essential functions, including cell signaling, communication and the transport of vital substances into and out of cells. They are critical targets for drug delivery and many proteins are now being identified as disease biomarkers ? early warning beacons announcing the pre-symptomatic presence of cancers and other diseases.
While study of the binding properties of membrane proteins is essential, detailed analysis of these complex entities is tricky. Now, Nongjian (NJ) Tao, Professor of Electrical Engineering, and director of the Center for Bioelectronics and Biosensors at Arizona State University's Biodesign Institute has devised a new technique for examining the binding kinetics of membrane proteins.
"This is a very important but very difficult problem to solve," Tao notes. "We demonstrate a new method of approaching the issue, which provides a quantitative analysis of protein interactions on the surface of a cell."
The technique ? known as SPR microscopy ? holds the potential to simplify the study of membrane proteins, thereby streamlining the development of new drugs, aiding the identification of diagnostic biomarkers and improving the understanding of cell-pathogen interactions.
The group's results appear in this week's advanced online issue of the journal Nature Chemistry.
Typically, proteins attached to or embedded in the cell membrane's lipid bilayer are either tagged with fluorescent markers or extracted from their locations, purified and immobilized on a glass surface in protein microarrays. These efforts may not accurately reflect native configuration and function.
Membrane proteins are complex structures whose subtle performance is often related to alterations in conformation and the particular binding kinetics at work. Existing techniques using florescent markers have been applied to pinpoint binding events, but these only permit the visualization of the protein before and after binding, omitting the dynamic processes evolving over time. Further, the use of fluorescent labels to tag protein molecules can interfere with the processes researchers hope to observe.
Alternately, proteins are extracted, purified and affixed to microarray slides ? a labor-intensive process that removes proteins from their native environment, potentially affecting the shapes they naturally assume in situ and/or altering protein function.
In the current study, a label-free imaging technique is applied in situ to membrane proteins, which are visualized using a property known as surface plasmon resonance. This effect occurs when polarized light strikes the surface of a glass slide coated with a thin metallic film of gold. Under proper conditions of wavelength, polarization and incident angle, free electrons in the metal film absorb incident photons, converting them into plasmon waves, which propagate much like waves in water.
When nanoscale phenomena, including membrane proteins, interact and disrupt plasmon waves, they cause a measurable change in light reflectivity, which the new microscopy method converts into an image. (Figure 1a illustrates the basic setup of this technique.)
Surface plasmon resonance had already been applied to extracted proteins to study binding kinetics, though Tao explains that many steps are required and proteins may lose their proper conformational characteristics. This is particularly true for proteins normally embedded in a cell membrane's lipid matrix.
Another important consideration for the study of membrane proteins is the fact that that they arrange themselves heterogeneously across membrane surfaces and modify their distribution during various cellular activities. This behavior is particularly important during a process known as chemotaxis, when cells direct their movements under the influence of chemicals in the surrounding environment. For this reason, a tool allowing for both spatial and temporal study of membrane protein distribution in real time is highly desirable.
Tao's method uses surface plasmon resonance to provide high-resolution spatial and temporal information, and also allows for simultaneous optical and fluorescence observation of the sample, combining the advantages of both label-based and label-free methods.
High spatial resolution proved particularly useful for observing the ways polarized membrane proteins (bearing hydrophobic and hydrophilic regions) rearrange themselves, assisting cell migration directed by surrounding chemicals. The phenomenon also plays an important role during immune recognition. Using SPR microscopy, the spatial distribution of membrane proteins in single cells during chemotaxis could be mapped in detail for the first time, using a chemoattractant to induce cell migration.
Cells for study are cultured directly on a gold-coated slide, which can be subjected to simultaneous bright-field, florescent and SPR imaging. A liquid containing binding ligands is then applied over cells and the binding events with cell surface proteins monitored with SPR.
The technique permits millisecond resolution of temporal events and sub-micron scale analysis of spatial distribution. (See Figure 1b). In the current study, the method examined the binding of membrane glycoproteins with lectin ligands, the spatial distribution of membrane receptor molecules and membrane protein polarization and redistribution events.
The versatility of the new method, allowing for simultaneous imaging in optical, fluorescent and SPR modes, promises to significantly expand the study of membrane proteins in their native state, improving the understanding of protein binding kinetics and speeding the development of drugs targeting membrane proteins.
Tao stresses that such techniques ? by more closely approximating in vivo conditions ? provide a valuable window into biological processes relevant to health and disease: "Cells are different from tissues which are different from human beings, but at least now we can move from a system on the surface of a glass slide to an actual cell surface."

An intriguing site near an Egyptian town called Dimai consists of a large, square formation and smaller features.

Remember that researcher who thought she spotted previously undiscovered Egyptian pyramids in Google Earth imagery? It turns out that there really are some ruins in the picture, but they?re not pyramids.
That's the verdict of an Italian archaeologist who has been surveying the area around the present-day town of Dimai in Egypt's Fayoum Desert.
"The features in Google images are well-known since 1925, when they were surveyed by G. Caton-Thompson and E.W. Gardner," Paola Davoli, an Egyptologist at Italy's University of Salento and co-director of the Soknopaiou Nesos Project, told me in an email. "They are natural mounds surmounted by a building (the biggest one) and by dug wells (in the other cases). For sure they are not pyramids, but their date and use are still not known."
The Dimai formations have been a subject of interest for many years. "We [have] still not dug them, but they will be the objects of future study by the Soknopaiou Nesos Project," Davoli said.
For more than a decade, the project has been doing a territorial survey of the area around Dimai, which was known as Soknopaiou Nesos during the Greco-Roman period in Egypt. The city is thought to have been founded by Ptolemy II in the third century B.C., on a site that shows evidence of habitation going back to the Neolithic period. During its heyday, it was situated on the shore of a large freshwater lake, but the lake has shrunk and gone salty since ancient times.
Davoli said the prevailing view is that the structures might have been watchtowers, designed to look over "an agricultural area or a paleo-lake just in front of them to the east," or perhaps tombs.
Dan Billin, a former newspaper reporter in New Hampshire who turned us on to the Soknopaiou Nesos Project, cites multiple reports about the Dimai site. "Micol was correct to think that at least one of the anomalies she saw on Google Earth was a man-made feature," Billin wrote in an email. "What she didn't manage to discover, however, was that archaeologists already knew about it, and that it's surrounded by numerous other archaeological sites."
Bob Brier, an Egyptologist based at Long Island University's C.W. Post Campus, said in an email that Billin's evaluation of the site "sounds like a reasonable scenario."

"Note, there is no mention of pyramids," Brier wrote.
Micol had pointed to another intriguing area of the Egyptian desert with four mounds and a large, triangular-shaped plateau, alongside the Nile in Upper Egypt, 12 miles (19 kilometers) from Abu Sidhum. The prevailing view is that those formations are not mounds or pyramids built by human hands, but are buttes carved by natural erosion.
Such formations are commonly seen in that part of the desert, James Harrell, professor emeritus of archaeological geology at the University of Toledo, told Life's Little Mysteries.

Listening to a favourite song might boost the brain's ability to respond to other stimuli in people with disorders of consciousness.
Music has been shown to have a beneficial influence on cognitive process in healthy people and those who have brain damage. For example, daily music therapy can help to enhance cognitive recovery after a stroke.
Fabien Perrin at the University of Lyon, France, and colleagues recorded brain activity in four patients ? two in a coma, one in a minimally conscious state, and one in a vegetative state ? while they were read a list of people's names, including the subject's own name. The list was preceded either by the subject's favourite music ? chosen by family and friends ? or by "musical noise". One patient listened to The Eagles' Hotel California, another was played the Blues Brothers' Everybody Needs Somebody to Love. The team then repeated the experiment with ten healthy volunteers.
In all four patients, playing the music rather than musical noise enhanced the quality of the brain's subsequent response to their own name, bringing it closer to the brain response of the ten healthy volunteers to hearing their own name, whether or not it was preceded by music or musical noise. The work was presented at the Association for the Scientific Study of Consciousness meeting in Brighton, UK, last month.
Perrin has two theories about what's going on. "Listening to preferred music activates our autobiographical memory ? so it could make it easier for the subsequent perception of another autobiographical stimulus such as your name," he says. "Another hypothesis is that music enhances arousal or awareness, so maybe it temporarily increases consciousness and the discrimination of your name becomes easier."
"The familiar music might be causing an emotional arousal effect, and once [the patient with brain damage is] aroused, there is a small window that opens for increased communication and the brain responds to the name," suggests Carsten Finke, a neurologist at Charit? Medical School in Berlin, Germany, who was not involved in the study.
So is Perrin's music sparking some form of consciousness in the people with brain damage? "I've not come across any responses like this to music before and it's way too early to conclude that it has any therapeutic effects in these patients," says Adrian Owen at the University of Western Ontario in London, Canada.
Perrin agrees that it's very early days. "We're showing that we can boost cerebral activity to obtain responses that are very similar to those obtained from healthy participants. It's in favour of enhancement of self-consciousness but we can't be sure."
But he says that confirming the results with more people could have direct implications on the sensory environment of patients in intensive care.

Last Tuesday marked the first ?Lazy Tuesdays? promotion at Bagatelle (www.bistrotbagatelle.com) in West Hollywood. While the title might implicate a laid back, relaxing meal there?s nothing ?lazy? about it unless you consider the dinner is a set four-course menu, prix fixe at $45 per person and that it?s served family style.
The menu will change seasonally and vary each week, but on Tuesday, it looked like this:

It was recommended we try their signature bottle of Bertaud Belieu Rose for a reduced price of $45 per bottle, to which we obliged, along with sampling their signature cocktails, many of which can be shared among a group in a scorpion-like bowl (we decided to pass on that).
Here?s the deal. The food was terrific ? the main course far outshining the rest and a reason to return for more. Keep in mind ? with a set menu, this is not the best choice for vegetarians unless you make arrangements in advance. While not a dessert lover there?s a few I can?t refuse, one being Bananas Foster and Bagatelle?s banana cheesecake is more like the classic NOLA dish with a side of cheesecake and that suited me just fine! The cocktails were excellent, my personal favorite being the ?Fuzzy Bee? made of Hendricks gin, lavender honey, fresh lemon, and champagne.
But? and there is a big but?
I suppose had I checked the website in advance (which features house music), or was more in-the-know about Bagatelle?s famously wild brunches in New York, I might have been prepared for the one thing that didn?t well, vibe, with me.
Let me be clear ? I have no problem with house music. In fact, I think it can be rather fun to get down to. But not while dining, and especially not in a restaurant with gorgeous chandeliers, white tablecloths, romantic candlelight, and among friends with whom you?d like to converse. To be fair, my friends and I still had a lovely evening; just not the one we were expecting.
This is not a critique on Bagatelle alone however. It seems to be a trend across the country and the world in fact (I recently had this very experience in a hotel in Africa of all places!) where to be ?cool? means to play swanky, electronic music that begs a party-like atmosphere. To that I say, ?No thank you!?
If I wanted that atmosphere, I?d head down the block to Greystone Manor with my dancing shoes on. To dine with a DJ spinning in the background is just not what dining is about to me. It?s like having a television in a restaurant that is not a sports bar ? it doesn?t belong. And certainly not when a dining experience is marketed as ?lazy.? ?Crazy Tuesdays? would be more appropriate.
What I expected was some soothing Louis Armstrong, perhaps something classic like Edith Piaf, or even more upbeat music with a New Orleans twist ? jazzy, bluesy ? but not a DJ and not house music that makes you want to eat fast, chomp furiously, and imbibe like your cocktail is a shot.
It?s not Bagatelle?s fault ? all the ?cool kids? are doing it; I just hang with a different crowd. It could be age, it could be simply preference. I?m sure there are plenty out there in the 21 to 27 age bracket who would disagree with me? The sames ones who showed up after 9 pm for dinner, but chose to drink instead.
What I can say is that I?d return to Bagatelle for the cocktails on a different night. I?d even return for the delicious food. But next time I?d like to actually enjoy the food and let it digest properly, so if ?DJ Fist Pump? is in the house, I?ll take my four courses home and eat in peace.

BANJUL (Reuters) - Gambia said on Monday it had executed nine prisoners, prompting critics to call for sanctions on the president whose plans to clear the country's death row by mid-September had already drawn a flurry of international condemnation.
Six civilians and three members of the military were executed by firing squad on Sunday after their appeal processes had been exhausted, the interior ministry said in a statement.
It named the prisoners and said they had been found guilty of a variety of crimes, all involving murder. At least one of those named had been previously identified as a Senegalese citizen but there was no immediate comment from Dakar.
President Yahya Jammeh last week announced in a speech plans to push through all pending death sentences saying he wanted to "ensure that criminals get what they deserve".
The decision drew condemnation from the African Union, Britain and the European Union, which promised a quick but unspecified response.
Monday's interior ministry statement appeared to reject outside influence, saying Gambia had the right to implement its own laws, and suggested more executions would take place.
"All sentences as prescribed by law will be carried out to the letter including the death penalty," it added.
Gambia lures British sun-seeking tourists to its beach resorts but Jammeh has frequently been criticized for his rights record since he seized power in a 1994 coup.
Amnesty International said that the executions took place last week. An umbrella group calling itself Civil Society Associations Gambia (CSAG) said it believed they were only made public due to the international debate over the issue.
Following the confirmation of the executions, Ousainou Darboe, a leading opposition leader, and CSAG appealed for targeted international sanctions to be imposed on Jammeh.
"This is not the first time - this has been going on too long. The abuses in the country are outrageous but nobody seems to notice," CSAG chairman Banka Manneh told Reuters.
"We want targeted sanctions. Jammeh's (foreign) help must stop ... We are willing to fight this fight but we cannot do it without some help from the international community."

Although the long-term fate of Property Assessed Clean Energy (PACE) financing is far from certain, another California court victory may help revive interest in the model.
A federal district court judge ruled that the Federal Housing Federal Agency (FHFA) violated federal law when it abruptly decided not to underwrite mortgages on homes that used PACE loans without any sort of public comment period.
One year ago, the same court required the FHFA to accept public comments related to its policy. The latest ruling negates the FHFA's old policy until it can consider those comments (the deadline for submissions is September 13).
"With this decision, the FHFA PACE policy is officially toast until the agency can develop a final rule pending the outcome of an ongoing rulemaking process," writes the Legal Planet blog.
The PACE structure, authorized in 27 states through legislation, makes it much easier for?property owners to finance?energy efficiency and renewable energy projects in homes and businesses. PACE?funds energy improvements with government bonds that are repaid via special tax assessments on the properties where improvements are made.?
But in July 2010, the FHFA issued a position statement calling the loans risky and inadvisable, which all but killed PACE programs. The issue for the federal government was that PACE loans might be paid back before banks or Fannie Mae or Freddie Mac if a property went into foreclosure.
?"To be sure, this decision does not clear up the long-term uncertainty around PACE, but it limits the FHFA?s ability to issue a sweeping policy undercutting the program. The final rule (whatever form it takes) will be subject to [Administrative Procedure Act] requirements and likely judicial scrutiny. The question now is whether FHFA appeals the decision and whether a higher court needs to resolve the split with?contrary PACE decisions?by New York courts on the issue of standing. Ultimately, local governments may be hesitant to restart their PACE programs until these questions are answered, and they?ve already missed a crucial window to use now-spent stimulus funds to launch them," writes Legal Planet.
The uncertainty over PACE has acted as a stimulus to solar leasing programs, which are helping many homeowners and businesses add renewable energy resources without hefty upfront capital investments.

If you look at my rating scale and even previous posts, I rarely write bad reviews. The times I have written bad reviews, I have tried to find 
redeeming value in the restaurant. Folks, this post will be my most scathing ever, as the restaurant failed at so many levels?that the public deserves to know. The offending restaurant is called ?Stella?s ? Serious Italian Cuisine? in Monarch Beach.
Here is a quick run-down on the failings before I go into details, so I don?t sound like a bitchy food blogger:
1)??? Poor Service
2)??? Poorly executed dishes = Bad recipe, flavor, ingredients, preparation and presentation
3)??? Over-Priced
4)??? Questionable freshness of seafood
5)??? Absent Management
Before I go into my tirade, let me tell you what they did well:

4)??? Nice wine list
Their Garlic Bread was the only bright spot of the evening
Good wines selection, but too bad it took us 30 minutes to get a bottle
?My wife and I visited Stella?s recently, during a weekday, as we were craving some good Italian food. We made the trip to Monarch Beach and had good expectations for this restaurant, but we came in with a smile and left with a frown and upset stomachs. We were seated promptly on the patio with a view of the ocean . . . things were shaping up.? We then proceeded to wait at our table for the next 25 minutes before we were acknowledged by the server or busboy. While we sat there like lost children, I watched the other table?s waiter spouting it up with his Italian(?) accent. I tried to get his attention and even made eye contact once, but he looked away from me quickly.? After twenty- five minutes, our waiter comes by to tell us, ? I?ll be right with you guys?, and skates away before I can saw a word. All I wanted was a bottle of wine to drink away my sorrows from the miserable experience. Finally he shows up and skips the formal greetings and says ?Sorry, I was slammed with a big order, what would you like to eat?? What, no foreplay? Aren?t you going to ask me if I wanted a beverage first? I told him that we would like to place drink orders and then he gave me the ?ohhh yeah? face. We also ordered their garlic bread since we hadn?t received a basket of bread yet?.and I was getting doubtful it would ever arrive. After things started to get better, we received our wine and garlic bread and things were shaping up. That was until our main courses arrived.
Here is what we ordered and here is went wrong?.
Fettuccini Con Scampi Pentangeli-Fettuccini surrounded by jumbo prawns saut?ed with garlic and saffron and tossed with Cognac cream sauce $26. (Exact description from menu). When I looked and smelled my dish, I instantly knew it was bad.
Multiple failings on this dish
Presentation: The color of the sauce was a little off, I know the cognac and saffron should make the sauce a little yellow, but even this yellow was off . . . something was not right. Second, the sauce appeared viscous and it clung to the pasta instead of draping over the pasta. They also used an orchid on top of the pasta as decoration. If you are furrowing your eyebrows right now, that was my reaction as well. Placing edible flowers on your food went out of style 15 years ago and last time I checked I wasn?t in Hawaii either . . . bad form for an Italian restaurant. Give me a rosemary sprig instead.
Aroma: Foul. Either they used a very smelly cheese, or used unfresh cheese/cream to provide the extremely unpleasant odor. Trust me, I am a big fan of stinky cheese to eat with my wine, so I don?t mind the smell of a particulary ripe cheese. But in this application, the chef either selected an inappropriate cheese for the dish or used unfresh ingredients. If it was the latter,? I will call the health department myself, because I did get serious gut pain for the next couple hours and an unpleasant experience with the porcelain edifice.
Taste:?The flavor was overly intense of cheese, cognac and saffron such that it was distracting to eat and I was not able to taste the linguini in the dish. The texture of the linguini told me that they used dry pasta and that they did not season the boiling water properly and did not cook it long enough. I don?t mind al dente, but the pasta was more chewy and bland. Although the shrimp were large, they were not fresh in terms of smell and texture. Perhaps the shrimp were a day or two past their prime, not unsafe, but they were losing their flavor and freshness. The texture of the noodles and sauce in my mouth was actually very bothersome. The sauce was extremely thick, almost a pasty texture.? The result was that the sauce stuck in my mouth, even after I swallowed, leaving a mildly unpleasant flavor in my mouth that only wine could cure.
My wife?s had the same experience with her dish: mediocre shrimp, bad sauce, bland presentation, and bad aroma. The only difference between her dish and mine was that her pasta was overcooked and mushy. Nothing redeeming in either dish. Literally we barely took five bites of our dishes and stopped, I really tried to like the dish, but stopped in fear that I would get sick. ?No one ever stopped to ask how our food tasted and if we were enjoying ourselves, the manager never came out to check either. You may ask, why didn?t you send the food back? Well folks, I kept hearing other customers grumbling about their dishes as well, so I didn?t think the restaurant could do much better. Sometimes you have to call it a loss and move on.?
?Aside: They use an old bar station on the patio as a bus boy station to get glasses, utensils and to pack up left overs. I will be honest, this station should be kept out of the customer?s perview, nothing is more gross than watching other people?s half-eaten food being packed up in front of you. Plus, bus boy stations are noisy with clinks and crashes. Lucky me . . . my chair faced their station the whole time.
My Final Thoughts
This restaurant needs a serious makeover, from the recipes, to training their staff, to a review of their food quality/rotation. I developed an upset stomach that lasted the next 7 hours, while the food passed though my intestinal track. Sorry to get that descriptive folks, but at $28 for this dish I would expect much better quality of ingredients and preparation. For $28 I would expect house-made pasta, fresh ingredients and a well-trained staff. If I paid $7 for this dish at Pasta Bravo, I would have just thrown the dish away and call it a day. At $28 for very mediocre pasta and shrimp dish, the restaurant is taking advantage of the community or is not aware that their quality has slipped.
I wanted to make sure that my experience was not a bad night for the restaurant, so I asked fellow foodies and average restaurant goers about their experience at Stellas, and it turns out that my experiences are not unique.? I recently interviewed three separate recent customers and they all gave me similar feedback: bad service, bad tasting dishes, high prices, and less than fresh seafood. To my readers, I personally do not like writing bad reviews and will always write the restaurant manager first with opportunities for improvement. Although this time I think Stella?s needs to hear the bad music in a public forum, so they can do some serious soul searching about what kind of restaurant they want to be. If you are the owner/manager of this restaurant, please change; we deserve better.?

But that still may not keep The Sun out of legal hot water, after the British tabloid printed the photos in its own pages last night.
When the photographs were first published earlier this week by Los Angeles-based gossip website TMZ.com, the royal palace quickly confirmed that the pictures did indeed show Prince Harry. But they also warned the Press Complaints Commission that they would consider any publication of the pictures an intrusion upon the prince's privacy.? As a result, Fleet Street and England's broadcasters ? even while writing up the Las Vegas escapade with typical royal-watching bemusement and enthusiasm ? have toed the line and not shown the photos themselves.?
But The Sun broke ranks today, running one of the candids under the headline "Heir it is!", arguing that the publication of the photos was a matter of public interest in England. "By yesterday, the photographs were indisputably in the public domain everywhere in the world," The Sun's editors explained in an article accompanying the photos.
That generated a legitimate public debate about the behaviour of the man who is third in line to the throne and increasingly taking on official duties, as he did most recently at the Olympics? closing ceremony. ...
But there is a clear public interest in publishing the Harry pictures, in order for the debate around them to be fully informed. The photos have potential implications for the Prince?s image representing Britain around the world.
There are questions over his security during the Las Vegas holiday. Questions as to whether his position in the Army might be affected.
The Guardian reports that Louise Mensch, a Conservative member of Parliament, made a similar argument, saying that "There is a clear, demonstrable public interest: the royal family receives money from the civil list; Prince Harry in inviting people to his room [had] the expectation of privacy so there's questions of judgment and questions of security."
But media lawyer Mark Stephens told the BBC that such arguments don't fly. "There?s absolutely no public interest" in seeing the photo itself.
Under English law, Mr. Stephens said, there is clear legal precedent that "if I can explain to you that there is a picture of the prince bare buck naked in a Las Vegas hotel room... unless there is some compelling reason for you to actually see that picture ... the media cannot publish the picture."
The problem, he said, is that the photos are both very intrusive to the prince's privacy and they convey no additional information needed to understand the situation.
"We know that he is bare buck naked, what more do you want to know?" he asked rhetorically. "You don?t need to see the picture."
When the BBC interviewer suggested that the photos raised issues of the royals' public funding and security, Mr. Stephens replied that "You can deal with all of those things, if indeed they are public interest ? by telling me what you?ve just told me," meaning that Harry appeared in the photo naked. "You don?t need to see the picture."
Such reasoning suggests that the palace's prompt acknowledgement that the photos pictured Harry was a way to remove them quickly from the public's view. Had Harry's identity been up for debate, the press would have a strong legal argument that the public needed to see the photos to determine whether the prince was indeed pictured.? By acknowledging that it was Harry, the palace headed off such arguments.
Some argue that the ubiquity of the photographs abroad and online may make the royals' efforts to dissuade their publication seem silly. The Sun's managing editor David Dinsmore called the situation "ludicrous," and Dominic Ponsford of the Press Gazette, a British journalistic trade magazine, wrote that "whether the pictures can now be considered private after being viewed so widely is debateable."
But in a legal sense, the photos' ready availability elsewhere is not likely to affect whether their publication is an invasion of Harry's privacy. Rather, it would likely only affect what damages that The Sun might be required to pay if found liable. By publishing photos already so widely seen, The Sun could argue that their publication's relative harm to the prince was minimal.
